Cronulla Sutherland Conveyancing FAQ's
What is Conveyancing?
Conveyancing is the legal process of transferring the ownership of a property from one person to another.
Do I need a Solicitor as well as a Conveyancer when buying or selling property?
No, In the early 1990's the NSW Government removed the monopoly that solicitors had in legal property matters by introducing Licensed Conveyancers. This allowed Conveyancers to do the same legal work in buying/selling real estate, businesses and other related matters. Conveyancers are equally qualified as solicitors in conveyancing law. Because conveyancing is all we do, you can be assured that we have an in-depth understanding of the law covering property transactions to ensure your matter is conducted with knowledge and experience. We are members of the Australian Institute of Conveyancers - NSW Division and are bound by the rules and standards set by the Institute and are regulated by the Conveyancers Licensing Act and Regulations.
Do you carry Professional Indemnity Insurance?
Yes. All Licensed Conveyancers are required to be covered by a Professional Indemnity Insurance Policy.
What is your fee structure?
We charge a flat fee for both purchases and sales. Our fee includes our professional costs of acting for you on your property transaction including doing all things necessary to bring your matter to settlement. Our fee also includes all disbursements incurred on your behalf and which are necessary to ensure your obligations under law are met and to ensure that you receive a clear title on settlement. Please contact us for a quote.
Why is there a difference between the conveyancing fees for buyers and sellers?
When buying a property, more complex and comprehensive searches need to be carried out to ensure you receive a good, clear title to the property. Therefore, both the professional fees and disbursement fees are higher when purchasing.
Is our sale or purchase transaction looked after personally by a Conveyancer?
Yes. You can be assured that your matter will be personally handled by a licensed conveyancer from the first meeting right through to settlement. Our Conveyancers are always available to answer any questions you may have at any time.
